Terms & Conditions – The Freestyle Footballers

1. Applicability

These Terms & Conditions apply to all bookings, agreements, and performances carried out by The Freestyle Footballers (“Performer”), unless explicitly agreed otherwise in writing. Any terms and conditions from the Client are hereby expressly rejected.

2. Booking & Confirmation

  • A booking is confirmed once the Client receives written confirmation (Through Email) from The Freestyle Footballers. This Email includes the, by the client accepted, quote with all relevant information.

  • The Performer may subcontract certain tasks to trusted third parties if necessary for proper execution of the agreement.

3. Fee & Payment

  • The total fee is all-inclusive (performance, travel, accommodation, and reasonable expenses).

  • Payment is invoiced after the performance and must be made within 14 days of the invoice date.

  • If payment is not received within 14 days, the Client is automatically in default. The Performer may:

    1. Send a formal reminder giving a reasonable period to pay.

    2. Send a final warning if payment is still not received.

    3. Hand over the claim to a collection agency or legal authority; all resulting costs are for the Client’s account.

  • The Performer may suspend further obligations until payment is received.

4. Cancellation & Termination

  • Both parties may cancel the agreement at any time, provided written notice is given.

  • If the Client cancels:

    • Less than 7 days before the event: 100% of the fee is due.

    • 7–14 days: 75% of the fee is due.

    • 14–30 days: 50% of the fee is due.

    • 30–90 days: 30% of the fee is due.

  • If the Performer cancels due to illness, force majeure, or unforeseen circumstances, efforts will be made to provide a substitute performer or reschedule the performance. Prepayments will be refunded if no replacement can be arranged.

5. Force Majeure

  • Neither party is liable for failure to perform obligations due to circumstances beyond their reasonable control, including illness, travel restrictions, extreme weather, or government orders. This does not include that the client can cancel the order due to general weather conditions such as wind, rain or snow. Payment still has to be due like stated in paragraph 4. Cancellation & Termination.

  • The Performer may suspend, reschedule, or partially perform obligations during such events.

6. Confidentiality

  • Both parties must keep all confidential information obtained during the agreement strictly confidential.

  • Confidential information includes any data explicitly marked as confidential or that should reasonably be considered confidential.

  • Materials on the website (texts, images, videos) may not be reproduced, modified, distributed, or published without prior written permission from the Performer.

7. Intellectual Property

  • All creative content, videos, photos, and other materials produced by the Performer remain the intellectual property of the Performer.

  • The Client may take photos or videos during the performance for personal use only.

  • Commercial use of recordings (advertising, broadcast, sponsorship) requires prior written consent and may be subject to an additional fee.

8. Liability

  • The Freestyle Footballers (Company) is not liable for indirect, consequential, or business damages (including loss of profit) arising from the performance.

  • The performer that performs the show on behalf of The Freestyle Footballer, can't hold the company (The Freestyle Footballers) liable for any (physical or mental) damages.

  • The Performer’s total liability is limited to the fee paid for the performance.

  • The Client is responsible for providing a safe environment for the performance (stage, flooring, weather conditions).

  • The Performer is not liable for damages caused by incorrect or incomplete information provided by the Client, unless such inaccuracies were clearly detectable.

9. Changes to the Agreement

  • If changes are required for proper execution of the performance, both parties will adjust the agreement in a timely manner and in mutual consultation.

  • Any change with financial or qualitative consequences will be communicated in advance.

10. Data Protection & Privacy

  • The Performer processes personal data according to the Privacy Policy.

  • Data is collected and processed to manage bookings, provide services, communicate with the Client, and send newsletters if consent is given.

  • Personal data is protected, stored securely, and only shared with trusted third parties necessary for the performance.

11. Complaints

  • Complaints must be submitted in writing within 14 days after the performance.

  • If a complaint is justified, the Performer will make reasonable efforts to remedy the issue.

12. Governing Law

  • These Terms & Conditions are governed by the laws of the Netherlands.

  • Disputes will be resolved by the courts of the Netherlands unless otherwise agreed in writing.
